Program Terms

This Terms and Conditions Agreement ("Agreement") is entered into between Performing in Education, LLC ("Company," "we," or "us") and You ("Client," "Member," or "You") upon purchasing the Simplify Writing® program ("Program"). By purchasing the Program, You agree to be bound by the terms stated herein.

Program Content:

The Program provides digital downloads, such as PDFs, PowerPoints, and Google files. No printed material will be provided. Any printed material depicted in images or video serves as examples only. You are responsible for printing any paper resources downloaded from the program.

Access to Program content is provided through the password-protected membership area. Full payment grants access to all materials included in the Program. A "lifetime access" purchase grants access for the lifetime of the Program. In the event of Program dissolution, You will be notified 60 days in advance. Company is not liable for failure to receive this notice.

Material Usage:

All content included in the Program, including text, graphics, logos, images, and compilations, is the property of the Company or its suppliers, protected by copyright and other intellectual property laws. A membership license grants access to copyrighted content for personal classroom use. Each teacher using the resources must possess a valid membership license. Sharing accounts or distributing copyrighted materials to non-members is prohibited and may result in account deactivation without refund.

Use of Program materials on commercial platforms, such as Outschool, is strictly prohibited. Any suspected misuse of content or trademarks should be reported to us.

Cancellation & Refund Policy - Personal Licenses:

A 14-day grace period is offered after the initial Program purchase. If You find the Program unsatisfactory, a full refund may be requested within this period. Refund requests and account inquiries must be submitted via email to [email protected].

Access will be revoked if a payment plan is canceled or payment fails, with no refund offered. Payments made outside the initial 14-day period are non-refundable.

Payment plans constitute an agreement between Member and Company. Cancellation without completing payments may result in an outstanding balance.

School Purchases and Purchase Order Policies:

Due to the digital nature of the resources, returns or refunds on school purchases are not approved. Schools are responsible for ensuring compliance with licensing terms and usage by their teachers.

Help Desk:

Help desk requests are addressed during business hours, Monday-Friday, 9am-3pm MST. Responses may take up to 48 hours.

Mistakes:

While efforts are made to ensure accuracy, errors may occur in materials. Please contact the Help Desk if you identify any errors, and updated files will be provided promptly.

Outages:

Periodic website outages may occur. Please retry access later if encountered. No guarantee of uninterrupted service is provided.

Refusal of Service:

We reserve the right to refuse or discontinue service to any user for noncompliance with these Terms and Conditions or for unprofessional or abusive behavior. You agree to indemnify and hold us harmless from any claims arising from breach of this Agreement.

Warranties:

You acknowledge that material obtained through the Program is at your own risk, and You are solely responsible for any resulting damage or loss. No warranties beyond those expressly stated herein are provided.

Arbitration:

Disputes arising from this Agreement shall be governed by the laws of the State of Arizona. Both parties agree to binding arbitration and waive trial by jury.

By purchasing the Program, You acknowledge and agree to abide by these Terms and Conditions.

Program Content

Content is in the form of digital downloads, such as PDFs, PowerPoints, and Google files. No printed material will be sent to you. Any printed material shown in images or video is for example purposes only. You are responsible for printing any paper resources you download from this program.

Content is provided to you by Company through the password-protected membership area. You will have access to all materials that are a part of the program you've paid in full for. A purchase of "lifetime access" gives you access to the platform for the lifetime of the Program. If at any time the Program is dissolved, you will be given 60 days notice to access content before dissolution. Company is not liable for failure to receive this notice.

Material Usage

All content included as part of the Program, such as text, graphics, logos, images, as well as the compilation thereof, is the property of the Company or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. A membership license grants you access to copyrighted content on the Program website for personal classroom use. Each teacher using the resources must have a valid membership license in order to use the copyrighted content in Program. Each license is for one classroom teacher only. It is a violation of the terms to share one account or to distribute the copyrighted materials from this program to non-members. Sharing login information with other teachers may result in your account being deactivated without a refund.

You may not use these lessons on any commercial platform, such as Outschool.

Cancellation & Refund Policy - Personal Licenses

Performing in Education, LLC offers a grace period the first 14 days after the initial purchase of the Program. This means that if you purchase Program and do not find that it's a good fit, you can contact us for a full refund within 14 days from your initial registration. Refund requests and account questions are accepted only through email at [email protected].

Company will revoke access if at any time a payment plan is canceled or payment fails, and Member will lose access to the materials with no offer of refund of payments made. Continuing access only applies to members who have paid for the program in full. Payments are non-refundable outside of the first 14 days after purchase.

Payment plans are an agreement between Member and Company. By entering into this agreement, Member agrees to complete payments unless canceled within the 14-day grace period. Cancellation of payments before the contract is paid in full without permission of Company may result in an outstanding balance.

School Purchases and Purchase Order Policies

Due to the digital nature of the resources, Company does not approve returns or refunds on licenses purchased by schools. Schools cannot ensure that the resources that their teachers have downloaded are no longer being stored on their computers or used in their lessons.

Help Desk

Help desk requests will be handled during business hours, Monday-Friday from 9am-3pm MST. We do not work on weekends or holidays. Please allow up to 48 hours for a response to your request.

Mistakes

These lesson materials are created by real teachers. Although they go through a thorough editing process, there may be small errors. Please contact the Help Desk if you find an error, and we will upload an updated file in a timely manner.

Outages

Occasionally, the Program website may experience a brief outage. If you encounter an issue, please try again later. No promises of perfect service are made.

Refusal of Service

Performing in Education, LLC reserves the right to refuse or discontinue service to any user for noncompliance with these Terms and Conditions. The Company may also refuse service to anyone acting in a manner that is unprofessional or abusive. You agree to indemnify, defend, and hold Performing in Education, LLC harmless from any claims and expenses, including reasonable attorneys’ fees, arising from or related to any breach by you of any terms of this agreement.

Warranties

Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from Program or through, or from, the service shall create any warranty not expressly stated in the terms of service.

Arbitration

The laws of the State of Arizona will govern this Agreement. The laws of the State of Arizona will govern any dispute arising from the terms of this agreement or breach of this agreement and you agree to personal jurisdiction by the state and federal courts sitting in Arizona. The parties hereby expressly waive trial by jury in any action, proceeding or counterclaim brought by either of the parties against the other on any matters whatsoever arising out of, or in any way connected with, these Terms and Conditions and agree to submit to binding arbitration.
