School Order Terms and Conditions

Performing in Education, LLC provides the Simplify Writing® program subject to the following terms and conditions:

Payment Terms
Payment for Simplify Writing® program purchase orders is due within 60 days of invoice date. Any accounts with outstanding balances past 90 days will have their product licenses revoked. Due to the digital nature of the product, no refunds will be issued once payment has been made.

Buyer assumes responsibility for any taxes or governmental charges imposed by federal, state, provincial, or local law relating to this Purchase Order transaction.

Access
Simplify Writing® license access will be provided on the agreed-upon start date and will expire on the date specified on the invoice. If the product license is not renewed, any materials downloaded to personal or school computers must be deleted.

Each teacher utilizing the Simplify Writing® program must possess a valid license issued by Performing in Education, LLC. Schools must ensure that a separate license is obtained for each staff member who will use the program materials. Only the staff member listed on the account may access the dashboard.

Our materials are accessible via our website only, and no software or other applications will be installed for access. Access to our accounts is restricted to staff members over the age of 18. No students may access the accounts.

Our online dashboard may experience intermittent downtime from time to time. Digital materials may be shared as Google files, and any issues on the Google platforms are not the responsibility of Performing in Education, LLC.

Unauthorized Sharing

Any intentional sharing of program materials or accounts among multiple users without proper licensing is strictly prohibited. If a school is found to be intentionally sharing materials or accounts, Performing in Education, LLC reserves the right to immediately revoke current access without issuing refunds.

Intellectual Property

All materials provided by Performing in Education, LLC are protected by intellectual property laws and are the sole property of Performing in Education, LLC. No materials may be distributed, reproduced, or transmitted in any form or by any means without the prior written permission of Performing in Education, LLC. Materials may not be altered or modified in any way and then distributed. Any unauthorized use, reproduction, or distribution of our materials constitutes copyright infringement and may result in legal action. Additionally, any training programs or materials utilizing our materials that have not been created by Performing in Education, LLC must be approved in writing before use.

Warranties
No claims or warranties are made regarding student success. Various factors contribute to proficiency. Schools are encouraged to ensure that each teacher completes our full course before beginning and has adequate time for direct writing instruction. In the event of any mistakes or inaccuracies in the materials provided, Performing in Education, LLC will correct reported mistakes promptly.

Limitation of Liability
Performing in Education, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from the use or inability to use the Simplify Writing® program. In no event shall the total liability of Performing in Education, LLC to the purchaser exceed the amount paid by the purchaser for the Simplify Writing® program.

Privacy and Data Sharing

By purchasing the Program, You grant Performing in Education, LLC permission to disclose the names and location of schools utilizing our program for promotional and marketing purposes. This information may be shared on our website, social media platforms, marketing materials, and other promotional channels.

Performing in Education, LLC affirms that no student or teacher data will be shared alongside the disclosure of school names and locations for promotional and marketing purposes. We are committed to protecting the privacy and confidentiality of all personal information in accordance with applicable data protection laws and regulations. Governing

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, United States of America, without regard to its conflicts of law principles. Any dispute arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts sitting in Arizona.

By submitting a purchase order for the Simplify Writing® program, the purchaser acknowledges and agrees to be bound by these terms and conditions.
