By purchasing this product, the following Terms and Conditions are entered into by Performing in Education, LLC (“Company”, “we”, or “us”) and You (“Client”, "Member", or “You”) agree to the following terms stated herein. Performing in Education, LLC (herein referred to as “Performing in Education, LLC” or “Company”) agrees to provide Program, “Simplify Writing” (herein referred to as “Program”) identified in the online commerce shopping cart. As a condition of participating in the Program, you agree to be bound by and to abide by all policies and procedures set out in this Agreement, including those incorporated by reference.
Content is in the form of digital downloads, such as PDFs, PowerPoints, and Google files. No printed material will be sent to you. Any printed material shown in images or video is for example purposes only. You are responsible for printing any paper resources you download from this program.
New membership content is provided to you by Company through the password protected membership area throughout the year. Daily lesson plans for units on the annual writing calendar will be provided 30 days in advance. Dates listed on the website for materials and training are subject to change.
Formal lesson plans will be provided to you from August-May. These lessons may be moved around to match your school schedule (including September start dates). Additional bonus materials will be provided for extra coverage. Some examples of this content are extra prompts, bonus lessons (like poetry), and grammar resources. We welcome requests from our members for new material, but we do not guarantee that every request will be honored.
All content included as part of the Program, such as text, graphics, logos, images, as well as the compilation thereof, is the property of the Company or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. A membership license grants you access to copyrighted content on the Simplify Writing website for personal classroom use. Each teacher using the resources must have a valid membership license in order to use the copyrighted content in the Simplify Writing Membership. Each membership license is for one classroom teacher only. It is a violation of the TOS to share one membership or to distribute the copyrighted materials from this membership to non-members. If you suspect that the content or trademarks of these resources are being misused please contact us.
If you cancel your membership, you may use the lessons you have downloaded. However, you will no longer be able to access any lesson plan updates, new bonus lessons, or member training.
Monthly and annual memberships renew automatically using your card on file. You can make changes to your membership payment under the My Account link, located in the menu on the top right of your screen. Click your name and/or profile picture to access this menu. You may also contact us.
Performing in Education, LLC offers a grace period the first 7 days after the initial purchase of the Simplify Writing program. This means that if you purchase a membership and do not find that it's a good fit, you can contact us for a full refund within 7 days from your initial registration. Canceling your membership from your dashboard will not trigger a refund, it will only prevent the next month from being charged. If you have downloaded more than 30% of the membership content within that 7 days, a refund may be refused. You may only request one refund. You may cancel your membership renewal at any time under the My Account link, located in the menu on the top right of your screen. Click your profile picture to access this menu, then click "Settings", then "Credit Card Settings". A partial refund will not be processed if you cancel in the middle of your plan period. If you decide to cancel your membership, you will lose any discounted pricing. If you decide to sign up for the membership again, you may not have access to the same pricing. You will lose access to all of the materials and the rights to use them upon cancellation.
Help desk requests will be handled during business hours, Monday-Friday from 9am-3pm MST. We do not work on weekends or holidays. Please allow up to 72 hours for a response to your request.
Occasionally, the Simplify Writing membership website may experience a brief outage. If you encounter an issue, please try again later. No promises of perfect service are made.
Performing in Education, LLC reserves the right to refuse or discontinue service to any user for noncompliance with these Terms and Conditions. You agree to indemnify, defend, and hold Performing in Education, LLC harmless from any claims and expenses, including reasonable attorneys’ fees, arising from or related to any breach by you of any terms of this agreement.
Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from Simplify Writing or through, or from, the service shall create any warranty not expressly stated in the TOS.
The laws of the State of Arizona will govern this Agreement. The laws of the State of Arizona will govern any dispute arising from the terms of this agreement or breach of this agreement and you agree to personal jurisdiction by the state and federal courts sitting in Arizona. The parties hereby expressly waive trial by jury in any action, proceeding or counterclaim brought by either of the parties against the other on any matters whatsoever arising out of, or in any way connected with, these Terms and Conditions and agree to submit to binding arbitration.
